LEGAL NOTICE

WiiRe Risk Solutions, S.L. (WiiRe), is an independent reinsurance intermediary authorised by the Dirección General de Seguros (DGSFP) with registered office at Calle Fernando el Católico 61, 28015. Madrid – Spain. Listed in the Company Register of Madrid under Volume 42470, Folio 150, Page M-751570, VAT no.: B16968653, and listed in the administrative register of the DGSFP (Spanish Directorate General of Insurance and Pension Funds) under Code RJ0100. Public Liability Insurance pursuant to Law 26/2006 of 17 July.

PRIVACY AND DATA PROTECTION

In compliance with the provisions of the Spanish Data Protection and guarantee of digital rights Act 3/2018 of 5 December 5, and as required by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation or GDPR), WiiRe, hereby informs you of its personal data protection policy.

  • Data controller:

  • Source of the data:

    We have your data because you have been or are a client or a contact person or representative of a client company. Your data might also be included in the documents to which we have had access in our responsibility to manage policies or claims for our clients, or in a public directory we have consulted.

  • Purpose:

    With regard to the personal data of our CLIENTS (or their employees), to establish a new relationship with a new client or to manage the policies and their amendments (including renewals) once contracted through our brokerage. This may include the collection and return of premiums, and even the arranging of compensation when processing the claims. We might also send marketing communications to current or potential clients, or where we must process your data by law. In some of these cases, the data processed may be of those classified as being of a special category, such as health-related data.

    In terms of THIRD PARTIES, in order to ensure the full coverage of the policy and the processing of claims, we process personal data on our service and insurance providers (companies, appraisers, adjusters, etc.) and auxiliary service providers to undertake our business (IT companies, cleaning companies, material suppliers, legal consultancies, language teachers, etc.). Furthermore, during said processing of the claim, we may process the data of injured third parties that might also in some cases include special category data.

    In relation to our EMPLOYEES, their data is processed in order to satisfactorily fulfil the employer-employee relationship and in some cases to comply with legal requirements.

  • Justification:

    To process the data of CLIENTS (or of their employees), the justifying basis is usually a contract with them, or compliance with a legal or regulatory obligation (e.g. prevention of money laundering and funding of terrorism). Justification might also include the legitimate interest of WiiRe to inform its clients of other products that we believe might be of interest, or express consent when there is still no business underway between the broker and the client, or because special category data is being processed.

    In the case of the data of THIRD PARTIES, justification normally arises from the existence of a contract with our suppliers, or we are intermediaries of one between the Insurance company and the client. We may also process data from injured parties in claims, in which case it is the legitimate interest to defend the interests of our client, or express consent in the case of special category data.

    In the case of the processing of the data of EMPLOYEES, the justification of WiiRe to process said data lies in the existence of the contract of employment, or a legal obligation. In the case of special category data, express consent shall also serve as justification.

  • Addressees:

    WiiRe does not foresee the international transfer of data. We do transfer it, under legally and regulatory required security measures, to Public Authorities or Bodies when required as such, and to our suppliers involved in the undertaking of our professional work regarding the policies in which we act as brokers, or related to WiiRe in terms of the management of its personnel.

  • Data retention period:

    We retain your personal data for as long as the contractual relationship remains valid. Once the contractual relationship has ended, your personal data shall be blocked for the legal limitation periods, generally for 6 years, pursuant to Article 30 of the Commercial Code, or 10 years for the Prevention of Money Laundering. After the corresponding blocked period, your data shall be deleted. Professional contact data shall be kept indefinitely unless we receive a request for objection or cancellation from you.

  • Rights:

    Data subjects are entitled to access to their personal data and to request its rectification when it is imprecise or incomplete, and where applicable to request its erasure when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

    You may object to the processing of your personal data, in which case we shall no longer process your data except for imperatively legitimate reasons or to make or defend any claims.

    You shall also be entitled to request the limited processing of your data; in which case we shall only retain it to make or defend claims. Finally, you are entitled to portability, to obtain a copy of your data in a structured, commonly used and machine-readable format.

    You may exercise said rights by sending a letter for the attention of the Data Protection Officer at the WiiRe address in Madrid, or by e-mail to  admin@wiire.es. You may also at any time withdraw the consent previously given.

OWNERSHIP

All the information contained on the website is the industrial and intellectual property of WiiRe Said company is responsible for exclusively exercising the rights to use the intellectual property indicated in any manner and, more particularly, the rights to reproduction, distribution, public communication and transformation. WiiRe does not fully or partially transfer or grant licenses or authorizations of any kind to users in relation to the intellectual or industrial property rights or those of any other manner in relation to the website.

Website users may view the elements and contents and even print them, copy them and save them on the hard drive of their computer or in any other physical medium, provided this is solely and exclusively for their personal and private use. Their use for commercial purposes, their distribution and their modification, alteration or decompilation is, therefore, strictly forbidden.

Users shall use the elements or contents of the website in a diligent, correct and legal manner and, more specifically, they agree to abstain from using them in a manner or for purposes or effects that are against the law, morality and good, generally accepted customs or public order. Where this is not the case, users shall remain solely responsible for any breaches incurred and for any losses they may cause in relation to WiiRe and/or third parties.

WiiRe may refuse, forbid or withdraw access to the website and/or its services at any time and without the need for prior notice to users who fail to fulfil these obligations.

EXCLUSION OF LIABILITIES AND GUARANTEES

WiiRe does not guarantee the availability and continuity of website operations and of the services it includes, privacy and security when using the website and its services, that unauthorized third parties may not have knowledge of the class, conditions, characteristics and circumstances of use that users make of the website and of its services, and the absence of viruses or other elements on the website that might lead to alterations in your computer system.

WiiRe rejects any liability for damages and losses of any kind that may arise from these circumstances.

LEGISLATION AND JURISDICTION

All the conditions, obligations and rights relating to the website service shall be governed by Spanish law. Any dispute arising from the website service provision shall be subject to the Courts and Tribunals of Madrid (Spain), expressly waiving any other local law that may apply.
